Magic AI Premium Version

Welcome to Magic AI! By subscribing to the Premium Version of Magic AI, you agree to comply with and be bound by the following terms and conditions. Please read these terms carefully before proceeding with your subscription.

1. Introduction​

These Terms and Conditions (“Terms”) govern your use of the Premium Version of the Magic AI app (“Service”). By subscribing to the Service, you agree to abide by these Terms. If you do not agree with any part of these Terms, please do not proceed with your purchase.

2. Subscription Plans

Magic AI offers two subscription plans for the Premium Version:

Monthly Plan: Billed monthly at the rate disclosed at the time of purchase.

Yearly Plan: Billed annually at the rate disclosed at the time of purchase.

3. No Free Trial

Magic AI does not offer a free trial for the Premium Version. You will be charged the full amount at the time of subscription based on your selected plan (Monthly or Yearly).

4. Subscription Renewal and Cancellation

  • Automatic Renewal: Subscriptions automatically renew at the end of their respective billing cycles (monthly or yearly) unless canceled at least 24 hours before the renewal date.
  • Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of the current billing cycle, and no refunds will be provided for the remaining period.
  • Changes to Subscription Plans: We reserve the right to change our subscription plans or adjust pricing for our Service at any time. Any price changes or changes to your subscription plan will take effect following reasonable notice provided to you.

5. Billing and Payment

  • Payment Methods: Payments for the Premium Version are processed through the app store platform from which you originally downloaded Magic AI (e.g., Google Play Store, Apple App Store). Payment methods accepted are subject to the terms of the respective platforms.
  • Billing Cycle: Your billing cycle corresponds to the subscription plan you selected (monthly or yearly). The billing date is the date you make the initial payment and renew automatically based on your subscription choice.

6. Refund Policy

All purchases for the Premium Version of Magic AI are final and non-refundable. We do not provide refunds or credits for any unused subscription period.

7. Access to Premium Features

Upon subscribing to the Premium Version, you will gain access to additional features not available in the free version of Magic AI. These features are subject to change and may be updated at any time to improve the user experience.

8. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you believe your account has been compromised, you must contact us immediately.

9. Controls For Do-Not-Track Features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.
California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

9. Termination of Service

We reserve the right to suspend or terminate your access to the Premium Version of Magic AI at any time, with or without notice, if you violate these Terms or engage in any unauthorized, illegal, or harmful conduct.

10. Modifications to Terms

We may revise these Terms from time to time. If we make significant changes, we will notify you through the app or via email. Continued use of the Service after changes are made constitutes your acceptance of the revised Terms.

11. Disclaimer of Warranties

Magic AI is provided “as is” and without any warranty or guarantee of performance. We do not guarantee that the Service will be uninterrupted, error-free, or free from harmful components.

12. Limitation of Liability

To the fullest extent permitted by law, Magic AI, its affiliates, and its licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses arising from your use of the Premium Version.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of [Your Country/State]. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in [Your Jurisdiction], and you waive your right to participate in a class action.
